1.1. MVPIN90DAYS is the brand of Fandom Connect Pty Ltd and/or one or more of its affiliated entities.

1.2. When you purchase MVPIN90DAYS-branded products, we handle your information to provide our products and services to you, as described in this Global privacy Policy, in our role as the business/controller.

1.3. When you purchase MVPIN90DAYS products under the brand of our corporate clients, we will handle your information on behalf of those clients as a service provider/processor in accordance with our agreement with them. 2. About this Global Privacy Policy

2.1. MVPIN90DAYS has implemented this Global Privacy Policy to describe our privacy practices and the privacy choices you in connection with using our website, mvpin90days.com, our mobile applications, and any other websites or services that link to this Global Privacy Policy. If you wish to make any inquiries regarding this Global Privacy Policy, you should contact our Privacy Officer in any of the ways specified in paragraph 16.

2.2. California residents can learn about their additional privacy rights in the “Additional information for consumers located in California” section below.

2.3. We provide important information for individuals located in the European Union, European Economic Area, Switzerland, and United Kingdom (collectively, “Europe” or “European”) below in the “Notice to European users” section.

3. What information do we collect and hold?

3.1. The types of personal information we may collect about an individual will depend upon the nature of our interaction with them. We may collect:

(a) Identifiers: including your name, contact details including telephone numbers (landline and/or mobile), current and previous address (including postal address) and email address and device identification number.

(b) Financial information: including your payment details, such as your bank account details.

(c) Demographic Information: including your age and/or date of birth and gender.

(d) Commercial Information: including records or goods or services purchased or considered, as well as purchasing or consuming histories or tendencies.

(e) Internet or Other Electronic Network Activity Information: including information regarding your interaction with product portals, websites, applications, or advertisements when you use our website, app and services usage data, for example when you create or log into your account or pair goods to your account.

(f) Geolocation Data: we collect your IP address automatically when you use our website or apps. We may be able to determine your general geographical location based on the IP address. Some of our mobile apps will also collect your precise location (e.g., your GPS coordinates), though users can turn off location tracking in their mobile device settings.

(g) Audio and Video Content: you may choose to submit audio and video content through your use of our services.

(h) Employment Data: including occupation and employment details including employment status, position title, remuneration, employee type, hire date, any previous work experience and education information, information from or in connection with your resume or job application if you apply for a position with us, or other relevant details.

(i) Profile Information: includes inferences drawn from any of the information identified above to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behaviour, attitudes, intelligence, abilities, and aptitudes, such as information from social media accounts and profiles including profile picture and language.

3.2. We are authorised to collect tax file numbers (TFNs) in Australia by the Income Tax Assessment Act 1936 (Cth). It is not compulsory for you to provide your TFN for our products and services, but if you do not, taxation law may require additional deductions to be made from amounts payable to you.

4.1. We collect and record information about individuals such as:

(a) users of our products or services
(b) our corporate customers, potential customers and their representatives
(c) our suppliers and potential suppliers, agents and potential agents, service providers and potential service providers, and their representatives, directors, partners, proprietors and shareholders
(d) contractors and subcontractors and potential contractors and subcontractors and their representatives in relation to providing goods and services to us
(e) our employees past and present, including applicants, and
(f) any other person who comes into contact with Scorz.

4.2. We may collect your information in the course of providing you with goods or services, or:

(a) when you use or buy our products or services
(b) when you provide us, or you offer or apply to supply us, with goods or services
(c) when you provide information to us in any way (including by completing a form, disclosing information over the phone or via email, or providing us a business card)
(d) when you request information, or make an enquiry, about us, our products or our services
(e) when you provide feedback to us
(f) when you visit or fill in a form on our website or applications (see paragraph 5)
(g) when you register for or use an account on our website or applications, for example to participate in a survey, contest or promotion
(h) when you visit premises from which we operate
(i) when you attend an event facilitated by us
(j) when you (or your employer) provide that information to us in the course of conducting or administering our relationship with you, or when you are carrying out activities in connection with our operations

4.3. We may also collect information about you from third parties and other sources such as:

(a) our corporate clients when we undertake activities and provide services to you on behalf of such clients
(b) your nominated representatives (e.g., spouse accountant, power of attorney, brokers and other professional advisors)
(c) publicly available sources of information including government entities from which public records are obtained
(d) related entities, companies and businesses of MVPIN90DAYS
(e) third party services if you choose to connect your account on our website or applications to your account on another service (for example, Google or Facebook), although you can stop sharing information from such other service if you delete our application or unsubscribe
(f) Wi-Fi access points, GPS signals and cell tower IDs when collecting location data, although you can remove our access to your location by using your mobile device settings (however doing so may result in you not being able to fully access our products and services)
(g) marketing vendors
(h) survey services
(i) service providers, payment processors and information processors

4.4. If the personal information we collect includes sensitive information, including health information, we will ask for your consent to collect sensitive information, unless applicable law allows us to collect it without your consent.

4.5. Where we engage with you multiple times over a short period in relation to the same matter, we may not provide you with a separate notice about privacy each time we engage with you.

If you choose not to provide your information to us for the purposes set out in this Global Privacy Policy, or if we do not or are unable to collect the information we require, we may not be able to provide you with requested information, products or services, or to effectively conduct our relationship with you.

5. Information collected via our website and applications

5.1. Information may be collected by us and by our third party service providers who assist us in operating our websites at http://mvpin90days.com/ , including its subdomains and any other website we operate from time to time.

5.2. We may use various technological methods from time to time to track the visiting patterns of individuals accessing our website or using our applications, including but not limited to the methods set out in this paragraph 5.

Google Analytics

5.3. We may use Google Analytics to help analyse how you use our website. Google Analytics generates statistical and other information about website use by means of cookies, which are stored on users’ computers. The information generated is used to create reports about the use of our website. Google will store this information.

Web Beacons

5.12. Web beacons are images that originate from a third party site to track visitor activities. We use web beacons to track the visiting patterns of individuals accessing our website.

Third party content (e.g., social media links)

5.13. Some of the content on our website or applications may include applications made available by third parties, such as social media buttons or links that allow you to share content or links to our website through the relevant third party platforms. These third party applications themselves may facilitate collection of information by those third parties, through your interaction with the applications and sometimes even if you do not interact directly with them. 6. What are the purposes, including business and commercial purposes, for which we use your  information?

6.1.    We use the  information we collect about you for our business functions and activities, in order to operate our business efficiently, and to market our products and services for the benefit of our customers.

(c) to otherwise assist customers by providing them with information and support
(d) to provide personalised content, offers and vouchers

6.3.     We may aggregate personal information for reporting, statistical and analysis purposes, and for business, product and service improvement purposes.  This allows us to better inform ourselves and anticipate our customers’ preferences and requirements, and to monitor and improve the effectiveness of our business, products and services.  We may also de-identify information for inclusion in such aggregated databases or reports.  

6.4.    We reserve the right at all times to monitor, review, retain, and/or disclose any information as necessary to satisfy any applicable law, but we have no obligation to monitor the use of our website or the applications or to retain the content of any user session.

6.5.    We may otherwise collect, use or disclose your  information where the collection, use or disclosure is:

(a) in accordance with this Global Privacy Policy or any agreement you enter into with us, or
(b) required or authorised by law.

7. When and to whom do we disclose your information?

7.1.    We may also disclose your personal information to:

(a) advertising partners, such as Facebook. You may at any time adjust your device settings for our app to disable the advertising ID to stop the sharing of device information with Facebook.  
(b) our corporate clients when we undertake activities on behalf of such clients
(c) third-party service providers (including mailing and printing houses, IT providers, payment processors, hosting services, analytics companies, and others) who assist us in undertaking our business functions and activities, including running our websites and operating our business
(d) professional advisors, such as lawyers, bankers, accountants, auditors and insurers
(e) third parties with whom you authorise or direct us to share your information
(f) Government, regulatory authorities and other organisations as required or authorised by law
(g) As necessary to facilitate the safety and security of our products and services, enforcing our terms and policies, responding to a legal request or claim, protecting against fraud or abuse, handling insurance and legal claims, and conducting audits, and to comply with our statutory, legal and self-regulatory obligations.

7.2.    As we continue to develop our business, we may buy, merge or partner with other companies or organisations, and in so doing, acquire customer information.  In such transactions, information may be among the transferred assets.  Similarly, in the event that a portion or substantially all of our business or assets are sold or transferred to a third party, we may also disclose certain information including your  information to a purchaser or potential purchaser in connection with the sale or potential sale of us, our business or any of our assets, including in insolvency.

8. International disclosures

8.1.    To provide our products and services and to operate our business in support of our products and services, it is necessary for us to process personal information in countries where our company and infrastructure are located, including in countries that are outside of the country in which you purchased our product or service or otherwise provided your information This may happen if: 

(a) our offices are based in a country outside of the country in which you reside
(b) we outsource certain activities to third parties based in a country outside of the country in which you reside
(c) transactions, information, services or products have a connection with a country based outside of the country in which you reside, or
(d) our computer systems including IT servers are located in a country based outside of the country in which you reside.  

8.2.    In particular, your personal information may be disclosed to third parties in Australia, USA, and such other countries in which those parties or their, or our, computer systems may be located from time to time, where it may be used for the purposes described in this Global Privacy Policy.  

8.3.    If you are based in Australia, you consent to the collection, use, storage and processing of your personal information in those countries, without us being responsible under the Privacy Act 1988 (Cth) for such use (or for any breach).  Where such parties are located outside of Australia, you may have rights to enforce such parties’ compliance with applicable data protection laws, but you might not have recourse against those parties under the Australian Privacy Act in relation to how those parties treat your personal information.

9. Other uses and disclosures

9.1.     We may collect, use and disclose your  information for other purposes not listed in this Global Privacy Policy.  If we do so, we will make it known to you at the time we collect or use your personal information. 

10. Marketing 

10.1.    You consent to us using your personal information for sending you information, including promotional material, about us or our products and services.  You also consent to us sending you such information by means of direct mail, email, SMS and MMS messages.  

10.2.    If you do not want to receive marketing information from us you can unsubscribe in any of the following ways: 

(a) clicking on the ‘Unsubscribe’ or subscription preferences link in a direct marketing email that you have received from us 
(b) logging into your account on the website or the application and editing your communication preferences, or
(c) contacting us using the contact details specified in paragraph 16.

11. Storage and security of personal information held by us

11.1.    We employ a number of technical, organizational and physical safeguards designed to protect the personal information we collect. 

11.2.    However, please be aware that no data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit or otherwise provide to us and you do so at your own risk.
‍If you create an account, you will be asked to select passwords for yourself to access the products and services, and this password will be used to allow you to use the products and services. You are responsible for maintaining the strict confidentiality of your account password, and for any activity that occurs under your account credentials, whether or not authorised by you.  

11.3.    If we find that we no longer require or have no further need for your personal information we may de-identify it or remove it from our systems and destroy all record of it.

12. Children

12.1.    Our website and services are not intended for children, and we do not collect personal information from them. We define “children” as follows:

(a) Residents outside of Europe: anyone under 13 years old; and
(b) Residents of Europe: anyone under 16 years old, or the age needed to consent to the processing of personal information in your country of residence.

13.1.    California residents can learn about their additional privacy rights in the “Additional information for consumers located in California” section below. 

13.2.    We provide important information about additional privacy rights for individuals located in Europe in the “Notice to European users” section below.

13.3.    If you are an Australian resident, you are generally entitled to access personal information that we hold about you.  If you request access to your personal information, in ordinary circumstances we will give you full access to your personal information.  Depending on the nature of the request, Scorz may charge for providing access to this information, however such charge will not be excessive.  However, there may be some legal or administrative reasons to deny access.  If we refuse your request to access your personal information, we will provide you with reasons for the refusal where we are required by law to give those reasons.

13.4.    If you are an Australian resident, you can access and correct some of your personal information through the website or the application by logging into your account and updating or editing your profile at any time.  Alternatively, a request for access can be made by contacting our Privacy Officer in any of the ways specified in paragraph 16.

13.5.    Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” or similar signals. To find out more about “Do Not Track,” please visit mvpin90days.com

13.6.    We take all reasonable steps to ensure that any personal information we collect and use is accurate, complete and up-to-date.  To assist us in this, you need to provide true, accurate, current and complete information about yourself as requested, and properly update the information provided to us to keep it true, accurate, current and complete.  

13.7.    Please contact us in any of the ways specified in paragraph 16 if you believe that the personal information is inaccurate, incomplete or out of date, and we will use all reasonable efforts to correct the information.

13.8.    It would assist us to ensure we properly understand your request, and allow us to respond more promptly, if requests are made in writing and include as much detail as possible.

14. How do we deal with complaints about privacy?

14.1.     If you feel that we have not respected your privacy or that we have conducted ourselves inconsistently with this Global Privacy Policy, please contact our Privacy Officer in any of the ways specified in paragraph 16 and advise us as soon as possible.  We will investigate your queries and privacy complaints within a reasonable period of time depending on the complexity of the complaint.

14.2.    It would assist us to respond to your complaint promptly if it is made in writing and sent to us by email at info@mvpin90days.com  Please detail information relevant to your complaint.

14.3.    We will notify you of the outcome of our investigation.

15.1.    We may, from time to time, review and update this Global Privacy Policy and any of its annexures, including to take into account new laws, regulations, practices and technology.  All personal information held by us will be governed by our most recent Global Privacy Policy, posted on our website at: where the Global Privacy Policy will be located.  Any changes to this Global Privacy Policy and its annexures may be advised to you by updating this page on our website.  We will aim to provide reasonable advance notice of such changes though this may not always be possible depending on the circumstances.  We encourage you to check this page from time to time for any changes.
